Restaurants Now Providing Take-Out

Restaurants all over the country are changing the way that they sell food and beverages to their customers. Many dining facilities that did not previously provide take-out are relying on this service to remain open. In many cases, those restaurants are not providing sales and service counters that meet the state and federal accessibility requirements. When takeout service is provided, an accessible counter must be provided regardless of the circumstances surrounding COVID-19.

Increased Litigation

The US economy is certain emerge from the COVID-19 crisis in a recession and historical data suggests that litigation is counter-cyclical. During times of economic downturn, overall litigation tends to increase and during times of economic prosperity, filed lawsuits return to a normal volume. Accessibility related lawsuits follow a similar pattern but in 2019, a record number of accessibility related lawsuits were filed in California. Only time will tell but we should expect to see a surge in accessibility related lawsuits in the near future.

Cory Cabral is our co-founder and Senior Certified Access Specialist. He graduated from San Diego State University with bachelors degree in Business Administration. After college he began his career in the sign industry where be became an expert in the field of ADA signage. During that time, he found that many of his clients were being put out of business because of ADA lawsuits. In most cases, the business owners simply did not know that their businesses had barriers to accessibility. He soon began searching for resources to help his clients avoid accessibility lawsuits and discovered the California Certified Access Specialist program. After immersing himself in all aspects of accessibility in the built environment by studying at the CalCasp Academy and the DSA, he became a California Certified Access Specialist. He is now CASp-630 and helps businesses limit exposure to ADA lawsuits by providing them with the resources necessary to make their products and services accessible to all.
